1. Scope and Provider
These Terms and Conditions apply to the use of the web application "WhosThatPro" (hereinafter "Service"), operated by [Company Name], located in Freiburg im Breisgau, Germany (hereinafter "Provider", "we", or "us").
2. Description of Service
WhosThatPro is a platform that allows professionals to collect and showcase structured testimonials ("Vouches") in a digital "Freundebuch".
Users can send and receive Vouches with or without creating a registered account. However, Vouches sent by unregistered users will appear as from an "anonymous" author to the receiver. Receivers who do not have an account must register to claim and save their received Vouches; otherwise, unclaimed Vouches are automatically deleted after 30 days. A registered account is required to create a public profile page.
3. User Accounts and Registration
Users must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. User-Generated Content (UGC)
Users may upload content, including but not limited to profile images, hero images, and the text within Vouches.
- You retain ownership of the content you upload.
- We reserve the right to remove or modify any user-generated content at any time, at our sole discretion, especially if it violates legal regulations, third-party rights, or these Terms.
- By uploading content, you grant us the right to contact you to request explicit permission to use your content for promotional and marketing purposes. We will not use your content for marketing without your prior consent.
5. Fees and Payments
The core functionality of WhosThatPro is currently provided free of charge. There are no in-app purchases or subscription fees at this time.
6. Limitation of Liability and Warranties
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, specific uptime, or the continuous functionality of the Service.
To the extent permitted by law, the Provider shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service.
7. Third-Party Services
Currently, the Service does not include third-party links or integrations that would require a separate liability disclaimer. Should third-party links be provided, the Provider assumes no responsibility for the content of external websites.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Freiburg im Breisgau, Germany.
9. Changes to the Terms and Conditions
We reserve the right to update these Terms and Conditions at any time. We will notify users of significant changes. Continued use of the Service after such changes constitutes acceptance of the new Terms.
